Plain terms for our services

These Terms of Service apply to funeral live streaming, memorial photography, memorial slideshow, and video services provided by MemorialStreamLive, a service of ESLPIX STUDIO LLC ("we," "us," or "our"). The person purchasing or arranging the services is the "client" or "you." Each booking is also governed by a written service agreement describing the selected package, locations, schedule, fees, team, and deliverables. Where the written service agreement is more specific than these terms, it controls for that booking.

1. Authority to book

By booking services, you confirm that you are at least 18 years old, have authority to enter the agreement, and have authority to arrange livestreaming, photography, and video coverage of the service. You are responsible for obtaining permission from the church, funeral home, cemetery, or other venue when permission is required.

2. Booking and payment

  • Standard bookings should be made at least 7 days before the funeral service.
  • Bookings requested 3 to 6 days before the service are rush bookings and may require an additional fee. Rush bookings are subject to team availability, location, venue access, and production requirements.
  • Services scheduled fewer than 3 days away may be considered only by phone, subject to team availability, venue access, payment, and written confirmation. Call (561) 425-8585. Acceptance is not guaranteed.

The package price, coverage, locations, deliverables, and any additional fees are confirmed in writing before payment. A booking is confirmed only after:

  1. The written service agreement has been signed;
  2. All required funeral information has been received;
  3. The service details have been confirmed; and
  4. The package has been paid in full.

Submitting an online form, speaking with a team member, or receiving a preliminary quote does not reserve the date.

3. Livestream viewing link

The viewing link is sent after the booking requirements above have been completed.

A "private viewing link" means a nonpublic link intended to be shared by the client with invited family members and friends. Unless the written agreement specifically provides an access-control method, anyone who receives the link may be able to open or forward it. The client is responsible for deciding who receives the link and for informing recipients that it should not be shared publicly. 4. Coverage

  • Each package includes only the locations, camera angles, team members, photography, slideshow services, and maximum coverage time stated on our pricing page and in the written agreement. Coverage times are measured according to the start and end times stated in the written agreement.
  • For a package covering both church and cemetery, the maximum coverage time includes church coverage, travel or procession time, cemetery setup, and graveside coverage. The livestream may pause while the team travels; the same viewing link is used for both locations whenever technically possible.
  • Additional locations, delays, overtime, schedule changes, or services exceeding the included coverage period may require an additional fee and are subject to team availability.

5. Photography

Photography coverage is limited to the level stated in the selected package and written agreement. Group photographs are taken only when the funeral schedule, available time, venue policies, available space, and family participation permit — they are not guaranteed. The number of photographs, delivery method, and delivery schedule are stated in the written agreement when applicable.

6. Venue rules and access

We follow the rules established by churches, funeral homes, cemeteries, clergy, and venue representatives. If a venue restricts camera locations, equipment placement, movement during the service, sound-system access, internet access, photography, lighting, or cemetery setup, we may modify the coverage to comply. A venue restriction does not constitute a failure by MemorialStreamLive when we provide the best coverage reasonably available under the circumstances.

7. Livestream reliability

We use professional production equipment and bring a backup cellular internet option to each service. Live transmission still depends on circumstances that cannot be fully controlled, including local cellular coverage, internet congestion, power availability, weather, streaming-platform availability, and venue restrictions. We do not guarantee uninterrupted live transmission.

If the live transmission is interrupted, we will continue recording locally whenever technically possible. All usable recorded footage will be incorporated into the edited memorial video. Any refund, credit, or other remedy for a failure attributable to MemorialStreamLive is stated in the written service agreement.

8. Edited memorial video

Footage from the included camera angles is professionally edited into one completed memorial video, delivered within 72 hours after the funeral unless the written agreement states a different deadline, the client submits required materials late, the service schedule materially changes, a force-majeure event occurs, or the parties agree otherwise in writing.

Raw camera files, audio files, editing projects, and other production files are not included unless specifically listed in the written agreement.

9. Recording availability

Unless the written agreement states otherwise, the livestream recording remains available through the provided viewing link for up to 90 days after the service, as described in our Privacy Policy. Families should download and securely preserve the final video files provided to them; we do not guarantee permanent online storage or permanent availability of a streaming link.

10. Memorial slideshows and music

The Tribute and The Legacy packages include a personalized memorial slideshow. To reduce the risk of muted audio, copyright claims, removal, or platform restrictions, we use original music, custom-created music, or properly licensed music. The use of a specific commercially released song is not guaranteed.

The client must submit the requested photographs, names, dates, and other information by the deadline stated in the written agreement. Late, incomplete, damaged, low-resolution, or incorrectly labeled materials may delay delivery or prevent the slideshow from being completed before the funeral.

11. Client responsibilities

  • Provide accurate service dates, times, addresses, and contact information;
  • Provide venue and cemetery details promptly, and notify us immediately of changes;
  • Obtain required venue permissions and inform us of photography or livestream restrictions;
  • Provide reasonable setup access;
  • Submit slideshow materials by the stated deadline;
  • Ensure the person signing the agreement has authority to arrange coverage; and
  • Provide any notices or obtain any permissions required for attendees, speakers, performers, or minors.

12. Schedule changes

Changes to the service date, time, church, funeral home, cemetery, or coverage requirements must be communicated as soon as possible. A requested change is not confirmed until we accept it in writing. Rescheduled coverage is subject to team availability, and a change that adds time, travel, staff, equipment, or locations may result in an additional fee.

13. Cancellation, rescheduling, and refunds

Cancellation, rescheduling, payment-retention, and refund provisions — including what applies if MemorialStreamLive must cancel — are stated in the written service agreement and disclosed before payment. Call (561) 425-8585 as soon as funeral plans change.

14. Force majeure

MemorialStreamLive is not responsible for delay, interruption, modification, or inability to perform caused by events beyond our reasonable control, including severe weather, illness, emergency, road closure, accident, government action, venue closure, cemetery restriction, power outage, network failure, streaming-platform failure, or similar events. When reasonably possible, we will attempt to modify, reschedule, record locally, or otherwise complete the affected services. Any refund or credit resulting from such an event is governed by the written service agreement and applicable law.

15. Third-party platforms

Livestreaming and file delivery may depend on third-party platforms, internet providers, mobile carriers, hosting providers, or cloud-storage services. Those providers may experience outages, impose access restrictions, change their services, or remove content under their own policies. We are not responsible for third-party actions outside our reasonable control, but we will take reasonable steps to preserve and deliver available recordings.

16. Personal use, ownership, and sharing

Finished deliverables are provided for the family's personal, noncommercial viewing and sharing unless the written agreement states otherwise. Copyright ownership and the scope of the client's license to download, copy, share, display, or modify the deliverables are stated in the written agreement. The client may not sell, license, commercially distribute, or use the deliverables in advertising without written authorization.

17. Marketing and portfolio use

We will not use photographs, audio, video, names, or other material from a funeral service in our advertising, social media, demo reel, website, or portfolio without prior written permission from an authorized family representative. Permission to livestream or record a service does not give us permission to use the material for marketing.

18. Limitation of liability

To the fullest extent permitted by law, MemorialStreamLive's total aggregate liability arising from a booking will not exceed the amount paid to MemorialStreamLive for that booking. This limitation does not apply to fraud, intentional misconduct, gross negligence, or liability that cannot legally be excluded or limited. We are not responsible for indirect, incidental, special, or consequential damages to the extent such limitations are permitted by law.

19. Privacy, communications, and signatures

Personal information submitted through the website or during booking is handled according to our Privacy Policy. You consent to receiving booking documents, invoices, confirmations, livestream information, and service communications electronically, and electronic signatures may be used for the service agreement and related documents.

20. Governing law and general terms

These terms and each booking are governed by the laws of the State of Florida, without regard to conflict-of-law principles; the venue for any dispute is identified in the written service agreement. If any part of these terms is held invalid or unenforceable, the remaining provisions continue in effect. A delay or failure to enforce any provision does not waive the right to enforce it later. These Terms of Service, the signed service agreement, the confirmed invoice, and any incorporated policies constitute the entire agreement concerning the booking; changes must be confirmed in writing.
